On Farm Stud Breeding Contract

WARRANTIES OF THE STUD OWNER:
1) Stud owner will exercise due diligence in the care, feeding and husbandry of the dam and cria.
2) Stud Owner acknowledges that all Stud Alpacas are BVD-PI tested.
3) Stud Owner provides a live birth guarantee as a result of this breeding service. It is deemed to be satisfied if the cria survives 7 days. In the event that the dam loses the fetus prior to birth by re-absorption or miscarriage, or in the case where the cria is born dead or dies within 7 days after birth of natural causes, Stud Owner will re breed the female free of charge to the same stud.
4) Stud Owner provides boarding, maintenance and husbandry for up to 60 days for the dam and cria at her side. If for some reason, that period is extended a boarding/agisting fee of $1.00 per day will be added for the dam and cria at side.
5) Stud Owner will sign an Application for registry to give the Dam Owner at the time a pregnancy is confirmed.
6) Stud Owner agrees that pregnancy shall be determined by spit checking at no cost to the Owner of Dam.
7) Stud Owner will arrange veterinary pregnancy confirmation by either a progesterone blood test, or ultrasound (if available) for the Dam prior to the time the Dam leaves the Stud Owners farm, if the Owner of Dam chooses. The fee for this will be billed to the Owner of Dam by the Stud Owner.
8) Stud Owner agrees that in the event the above mentioned dam is not impregnated within 60 days, the Owner of Dam shall receive a full refund of all funds paid for this particular breeding, provided that prior to refund at the Owner of the Dam's expense the dam is examined by a licensed veterinarian and a written and signed report is provided by the veterinarian ruling out any reproductive deficiencies or problems on part of the dam.
WARRANTIES OF THE OWNER OF DAM:
a) The Dam has no venereal disease;
b) The Dam and her cria are free of any vaginal discharge;
c) The Dam has not been exposed to any stud for at least 60 days prior to this breeding;
d) The Dam is not pregnant;
e) The Dam has no difficulty in conception or in retaining a fetus upon conception;
f) The Dam is free of all infections and communicable diseases. The Dam Owner agrees that the dam has had a BVD-PI test, and that the Dam is negative for BVD-PI. If the Dam has a cria at her side, the cria will be tested for BVD-PI instead the Dam. The test shall be at the expense of the Dam Owner.
g) The Dam has no known genetic defect.
h) The female has been dewormed within the preceding 4 weeks.
i) The Dam is halter trained and manageable.
j) The Owner of Dam will provide a photocopy of CLRC/CLAA Registration and a color photo of the Dam and cria for identification purposes.
k) The risk of loss or injury for the female and cria at her side shall be of the Owner of the Dam while the female is at the Stud Owners farm. It is recommended that the Owner of Dam have full mortality insurance while the Dam and Cria are in the Stud Owners care.
l) The Owner of Dam shall be solely and completely responsible for any loss, damage or disease caused to the Stud Alpaca Male referred to above arising out of or any breech or misrepresentation of the warranties above. If the above warranties are misrepresented, the contract shall be terminated without refund by the Stud Owner.
Terms and Conditions
1. This contract is personal to the Owner of Dam and may not be transferred.
2. Any veterinary costs associated with the Dam or Cria will be billed to the Owner of Dam by the Stud Owner.
3. The Owner of Dam is responsible for all transportation, and costs of transportation of their Dam and Cria. The Owner of Dam agrees to pay to Stud Owner for one breeding to the Stud Alpaca listed above, the sum of ________ Including all applicable taxes.

Owner of Dam and Stud Owner warrants that they have read this entire breeding/agisting agreement and understand its terms and content.
This is the entire agreement between the parties.
All previous discussions and negotiations have been merged into this written agreement.
The parties have agreed to conduct business by fax or email, originals will be forwarded by mail.
If any dispute arises between the parties, venue and jurisdiction shall lie under the Province of Ontario laws, where Stud Owner resides.
